The Electric Vehicle Incentive program (the “Program”) is a limited-time promotional incentive to provide a partial, fixed-amount reimbursement for those participating homeowners who purchase or lease an electric vehicle. The Program is subject to the following terms and conditions (the “Terms and Conditions”). Capitalized terms used and not defined in these Terms and Conditions have the respective meanings assigned to them in the Agreement.
ELIGIBILITY: Participation in the Program is limited to owners of townhomes in the Georgia Power Smart Neighborhood who have fully executed and entered into the Agreement. You must currently reside in the townhome to be eligible. To be eligible to participate, you must also be a licensed driver in good standing and maintain motor vehicle insurance as required by the State of Georgia. This Program is void outside the state of Georgia and where prohibited by law.
PROGRAM PERIOD: The Program begins on November 1, 2019, at 12:00:01 a.m. ET and ends on July 1, 2020 at 11:59:59 p.m. ET (the “Program Period”). GPC’s computer is the official time-keeping device for the Program.
HOW TO RECEIVE VOUCHER: During the Program Period, follow the directions from the Program’s marketing materials to send an email requesting a 90-day voucher to participate in the Program. The first ten (10) persons to request a voucher for the Program will receive the voucher. Vouchers will be good for ninety (90) days and will be subject to the instructions and terms of the voucher, as well as these Terms and Conditions. If a voucher is not timely claimed, it is void and will be awarded to the next person who requested a voucher within the Program Period, provided that no more than ten (10) vouchers may be claimed in the aggregate for the Program.
HOW TO CLAIM AWARD: To participate, You must receive a voucher and follow the directions on the voucher to timely submit proof of purchase or lease along with the voucher and all other required materials. The Program requires that during the Program Period you purchase or lease (at least two (2) years in duration) a new or used car, truck, or SUV powered solely by electricity (an “EV”). For purposes of clarity, the Program does not extend to the purchase or lease of hybrid vehicles (plug-in or otherwise) or motorcycles, carts, or scooters.
All materials must be received by the end of the Program Period. However, this Program is limited to the first ten (10) participants to receive and use the provided vouchers. All required materials must contain complete and correct information, as measured and determined by GPC in its sole discretion. Your ability to participate in the Program is limited both by the Program Period and the timeliness of potential participants’ voucher requests. An earlier voucher request increases but does not guarantee your chances of participation in the Program.
Proof of submission is not proof of receipt. Limit one (1) entry submission per person and per residence. Any attempt by a person to enter more than once may result in disqualification.
PARTICIPANT NOTIFICATION: The Program participants will be notified by GPC following processing of the submitted participation materials. GPC shall have no liability for any notification that is lost, intercepted or not received by a potential participant for any reason. If a potential participant does not respond within two (2) days after the first notification attempt, or if the notification is returned as unclaimed or undeliverable to such potential participant, such potential participant may be disqualified and an alternate participant may be selected. If any potential participant is found to be ineligible, or if he or she has not complied with these Terms and Conditions or declines participation for any reason prior to fulfillment of the Incentive Amount (defined below), such potential participant will be disqualified and an alternate participant may be selected.
INCENTIVE AMOUNT AND FULFILLMENT: GPC will give to each chosen and verified Program participant one (1) fixed payment in the amount of five thousand dollars ($5,000; the “Incentive Amount”). The form of the payment shall be made in a single payment by check within thirty (30) days of GPC’s receipt, verification, and processing of the submission materials. No further payment or consideration will be made beyond single payment. To the extent allowed by law, winner is solely responsible for the payment of any taxes that may be due as a result of the acceptance or use of the Incentive Amount or participation in the Program. The Incentive Amount is non-transferable. The Incentive Amount is provided "AS IS." GPC makes no warranty or guarantee, either express or implied (including, without limitation, quality, merchantability and fitness for a particular purpose) in connection with this Program.
By accepting the Incentive Amount, You agree that the purchased or leased EV will be used by the residents of and remain primarily located at your townhome (including, without limitation, the primary location for charging) for two (2) years following the close of the Program Period. If You sell the EV, terminate the lease, sell or move away from your townhome, or otherwise prevent the EV from residing at your townhome during the two-year period, you will refund the Incentive Amount pro rata by day to GPC.
GENERAL PROVISIONS: You agree, to the extent allowed by applicable law, that GPC, its Affiliates, and their respective Representatives shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, from participation in the Program, use of the Incentivized Amount, any vehicle-related activity, any Program-related activity, or from participant’s acceptance, receipt, possession and/or use or misuse of any Incentive Amount. GPC is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due submissions or notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. GPC reserves the right in its sole discretion to disqualify from this Program and any other promotions offered by GPC, any individual who is found to be tampering with the participation process or the operation of the Program, to be acting in violation of these Terms and Conditions, or to be acting in a disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Program, or to annoy, abuse, threaten or harass any other person.
GPC reserves the right to modify, extend, suspend, or terminate the Program, in whole or in part, at any time and for any reason.
